PURPOSE
These General Terms and Conditions govern the purchase of the products offered on the website www.escornalbougourmet.com, owned by AGRICOLA I CAIXA AGRARIA I SECCIO DE CREDIT, S.C.C.L. (hereinafter, ESCORNALBOU GOURMET).
The purchase of any of the products implies full and unreserved acceptance of each and every one of these General Terms and Conditions, without prejudice to the acceptance of any Specific Conditions that may apply when purchasing certain products.
These General Terms and Conditions may be amended without prior notice; therefore, it is advisable to read their contents carefully before purchasing any of the products offered.

All notifications and communications between users and ESCORNALBOU GOURMET shall be deemed effective, for all purposes, when made by any of the means indicated above.

PRODUCTS
Our online shop sells extra virgin olive oil from our own production.
The products offered, together with their main characteristics and their price, are displayed on the screen.
ESCORNALBOU GOURMET reserves the right, at any time, to decide which products are offered to customers. Accordingly, ESCORNALBOU GOURMET may, at any time, add new products to those currently offered. Likewise, ESCORNALBOU GOURMET reserves the right to withdraw or cease to offer, at any time and without prior notice, any of the products offered.
Notwithstanding the foregoing, the purchase of products may require the USER to register, creating a personal account in order to access them.
Once on www.escornalbougourmet.com, and in order to purchase the different products, the User must follow all the instructions indicated in the purchase process, which will entail reading and accepting all the general and specific terms and conditions set out on www.escornalbougourmet.com.

AVAILABILITY AND SUBSTITUTIONS
ESCORNALBOU GOURMET seeks to guarantee the availability of all the products advertised on www.escornalbougourmet.com. All the products offered are in stock. However, if any product ordered is not available or has sold out, the customer will be informed by email as soon as possible.

PURCHASE AND/OR CONTRACTING PROCESS
To make any purchase on www.escornalbougourmet.com, the customer must be of legal age.
In addition, the customer must register on www.escornalbougourmet.com by completing a data collection form, providing ESCORNALBOU GOURMET with the information necessary for the purchase; such data must in all cases be truthful, accurate and complete with regard to their identity, and the customer must expressly consent to the ESCORNALBOU GOURMET privacy policy.
The steps to complete a purchase are as follows:
Select the product.
Add it to the cart.
Confirm the purchase.
Fill in the data collection form.
Make the payment.
It is also advisable for the customer to print and/or save on a durable medium a copy of the terms of sale when placing their order, as well as the acknowledgement of receipt sent by ESCORNALBOU GOURMET by email.

We send the invoice in the parcel and by email.

DELIVERY
Orders will be delivered to the address indicated by the customer at the time of purchase, according to the delivery option selected.
Our delivery area covers the following regions: mainland Spain and the Balearic Islands.
- DELIVERY TIMES
Delivery times depend on the destination country and will normally range from 4 to 6 working days.

PRICES, COSTS AND TAXES
The prices of the products shown on www.escornalbougourmet.com are expressed in Euros, unless otherwise stated, and are guaranteed during their period of validity, except for typographical errors, regardless of the destination of the order.
The final prices of all the products (and, where applicable, the final prices per unit of measurement, when required), together with their characteristics, offers, discounts, etc., are shown for each of the items listed in the www.escornalbougourmet.com catalogue.
Product prices include VAT.
The applicable VAT rate is 10%.
Shipping costs: calculated during the purchase process.
Product prices may change at any time. In such cases, the applicable price will be the one in force at the time the order is placed. In any case, the final cost will be communicated to the customer during the electronic purchase process before they confirm their acceptance.

METHODS OF PAYMENT
The following payment methods are available:

Credit or debit card
You can pay immediately through our bank’s secure SSL payment gateway. If it is necessary to make any refund or cancel the order, the amount will be reimbursed to the same payment card.
This method does not entail any additional cost.

Bank transfer
With this payment method, you will receive an email after completing your purchase. It will contain the bank details of Escornalbou Gourmet so that you can transfer the amount of your order.
We will start preparing your order once we have received your payment.
Important: in order for us to match your payment immediately, it is essential that you indicate your order number as the payment reference. You will find this number in the order confirmation email.
If you return an order paid by bank transfer, we will refund the purchase amount to the same account from which the transfer was made.

RETURNS AND RIGHT OF WITHDRAWAL POLICY
In accordance with applicable regulations, the consumer and user shall have the right to withdraw from the contract within a maximum period of 14 calendar days without having to state any reason and without incurring any costs, except for those provided for in Articles 107.2 and 108 of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users.
This right of withdrawal does not apply, among others, to:
Goods that are sealed and are not suitable for return for health protection or hygiene reasons.
Therefore, for our products returns are not accepted, except where the packaging is found to be broken or damaged during transport at the time of delivery. In such cases, the goods will be replaced at no additional cost to the customer. To do so, please contact our Customer Service.

WARRANTY
Consumable products are excluded from warranty coverage.
Our products are marketed with an 18-month shelf life and are correctly classified as Extra Virgin Olive Oil.

CUSTOMER SERVICE AND COMPLAINTS
To submit any complaint or claim to ESCORNALBOU GOURMET, the customer must contact the customer service department either by calling 977834011 or by sending an email to tienda@escornalbougourmet.com.
In accordance with the EU Regulation on online dispute resolution in consumer matters and pursuant to Article 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform, available at the following link: http://ec.europa.eu/consumers/odr/.

APPLICABLE LAW
These terms and conditions shall be governed by the Spanish legislation in force.
The languages used shall be Spanish and Catalan.
